Software End User License Agreement

1. Agreement information

1.1. Terms used in this agreement

1.2. Parties to the agreement

This license agreement (hereinafter — the Agreement) is made between the Holder of the Rights to the IMAGE and the User.

1.2.1. The Holder of the Rights — BaseALT LLC (Taxpayer Identification Number 7714350892).

1.2.2. The User — any physical person, legal person, state authority, municipal authority or other economic entity.

1.3. Subject matter of the Agreement

This Agreement regulates the User's rights to use the IMAGE, as well as the individual software applications included therein (hereinafter — the applications) and other results of intellectual activity and means of identification, to the extent set forth in this Agreement.

1.4. Making of the Agreement

This Agreement represents a contract for granting a simple (non-exclusive) license to use the IMAGE, which is made using the simplified procedure (an open license, Article 1286.1 of the Civil Code of the Russian Federation). First use of the IMAGE by the User, as it is defined by the specified conditions, implies the User's consent to enter the Agreement.

1.4.1. Use of the IMAGE

This Agreement authorizes the User to use the IMAGE in accordance with the terms and conditions of the GNU General Public License version 3 (GPLv3), under which the User shall be granted the following rights and shall abide by the following constraints when using it:

The right to distribution of the Custom Image containing the IMAGE shall be granted only on the condition that the Custom Image is being distributed under the GPLv3.

Should the need for distribution of the IMAGE as part of the Custom Image under a license different from GPLv3 arise, a separate written license agreement with BaseALT LLC shall be made, stipulating the terms for license fee:

1.5. Transferring the rights to third parties (Sublicensing)

Under this Agreement, it is allowed to grant the right to use the result of intellectual activity (the IMAGE) to third parties.

2. Rights of the parties

2.1. Rights to the IMAGE

The IMAGE contains both free and non-free components. The permissions to distribute the non-free components as part of the IMAGE have been obtained from the corresponding holders of the rights by the Holder of the Rights.

2.2. Using free applications included into the IMAGE

All free applications included into the IMAGE are accompanied by license agreements, which for an unlimited period of time and at no fee grant you the following non-exclusive rights effective in the territory of any country:

For 3 (three) years after publishing the IMAGE, the Holder of the Rights shall provide the source code of any free application included into the IMAGE at the User's request via the Internet.

2.3. Using non-free applications included into the IMAGE

For all the non-free applications included into the IMAGE, the permissions for their distribution as part of the IMAGE and use by end users have been obtained from the corresponding holders of the rights.

2.4. Other rights

The right of authorship, the right to the name and other personal non-property rights of the author, which are unalienable according to the applicable national laws, or which have not been granted to you by the applicable laws or license agreements for the individual applications included into the IMAGE, are reserved by their holders and are not granted to the User.

3. Liability of the parties

3.1. The copyright rights to the IMAGE and the applications included therein, including the exclusive right to authorize the usage of the applications, are protected by the copyright laws, including the applicable international copyright treaties. All the responsibility for observing the national laws when using the IMAGE and the applications included therein lies with the User.

3.2. The IMAGE and the applications included therein are provided “as is”, except if otherwise stated in the Commercial Use Agreement. The Holder of the Rights makes no warranties as to error-free and uninterrupted operation of the IMAGE or its individual applications and/or features, the fitness of the IMAGE for particular purposes, nor does it guarantee validity, accuracy, completeness and timeliness of data or make any other warranties except expressly provided herein.
